Timethos Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Voices of History Foundation(“we,” “us,” or “our”) governing your use of Timethos (the “Service”). By creating an account or using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

Timethos is an educational platform on which students read lessons and hold structured conversations with simulations of historical figures generated by artificial intelligence. The Service is provided for educational purposes only. It is not a source of professional advice of any kind — including legal, medical, financial, or mental-health advice — and must not be relied on as one.

2. Eligibility and Accounts

You must be at least 13 years old to use the Service, unless your access is arranged by a school or institution that has provided or obtained any consent required by applicable law. You agree to provide accurate account information, to keep your password confidential, and to notify us promptly of any unauthorized use of your account. You are responsible for activity under your account. Accounts are personal and may not be shared, sold, or transferred.

3. AI-Generated Content — Important Disclaimer

The figures on Timethos are fictionalized, machine-generated simulations. Nothing a figure says is the statement, opinion, or endorsement of any real person, living or dead, or of Voices of History Foundation. AI output may be inaccurate, incomplete, offensive, anachronistic, or otherwise wrong, despite our design efforts. You are responsible for evaluating any output before relying on it, and you agree not to present AI output as the words of a real person.

Historical figures are depicted for educational commentary and criticism. Portraits and voices of figures are original, designed creations — voices are never cloned from real recordings, and living figures are never depicted photorealistically.

4. Acceptable Use

You agree not to:

  • use the Service for any unlawful purpose or in violation of any applicable law or regulation;
  • attempt to bypass authentication, rate limits, or other technical or security controls, or probe, scan, or test the vulnerability of the Service without written authorization;
  • attempt to extract, jailbreak, or manipulate the AI systems into producing content that violates these Terms, or use the Service to generate harassing, hateful, or sexually explicit material;
  • harvest or scrape data from the Service, or use the Service or its output to train a competing machine-learning model;
  • impersonate another person, misrepresent your affiliation, or submit another person’s personal information without authority;
  • interfere with or disrupt the Service, including by imposing an unreasonable load on our infrastructure;
  • resell, sublicense, or commercially exploit the Service without our written permission.

We may investigate violations and may suspend or terminate accounts that breach these Terms.

5. Your Content

You retain ownership of the content you submit to the Service (your messages, spoken words, and written work). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, and display that content as needed to operate, provide, secure, and improve the Service, including processing it through the third-party AI providers identified in the Privacy Policy and making it available to the educator(s) who administer your cohort. You represent that you have the rights to the content you submit.

6. Our Intellectual Property

The Service — including its software, design, lesson content, figure personas, portraits, voices, and trademarks — is owned by Voices of History Foundation or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended educational purpose. No other rights are granted.

7. Educator and Institutional Use

If you use the Service as part of a class, your educator and institution have the access described in the Privacy Policy, and your use may also be subject to your institution’s policies. If there is a separate written agreement between us and your institution, that agreement controls to the extent it conflicts with these Terms.

8. Availability, Changes, and Termination

The Service is provided on an as-available basis: we may add, change, or remove features, courses, or figures at any time, and we do not guarantee uninterrupted availability. We may suspend or terminate your access at any time for breach of these Terms, for risk to the Service or other users, or upon discontinuation of the Service. You may stop using the Service and request account deletion at any time as described in the Privacy Policy. Sections 3, 5, 6, and 9 through 13 survive termination.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT (INCLUDING ALL AI-GENERATED OUTPUT) ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT ANY AI OUTPUT IS ACCURATE, COMPLETE, OR SUITABLE FOR ANY PURPOSE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOICES OF HISTORY FOUNDATION, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR EDUCATIONAL OUTCOMES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE AND (B) ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN THAT CASE OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Voices of History Foundationand its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms, your misuse of the Service, or your violation of any law or the rights of any third party. This section does not apply where prohibited by law, including to consumers in jurisdictions that disallow such clauses.

12. Dispute Resolution; Arbitration; Class-Action Waiver

Please read this section carefully — it affects your legal rights. Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court or seek injunctive relief for intellectual-property misuse. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION OR OTHER REPRESENTATIVE PROCEEDING.

You may opt out of this arbitration agreement by emailing founders@vohfoundation.com within 30 days of first accepting these Terms, stating your name, account email, and intent to opt out. If the class-action waiver is found unenforceable as to a particular claim, that claim shall proceed in court, and the rest of this section remains in effect. Where this arbitration agreement does not apply or is unenforceable, disputes shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.

13. Governing Law; General Terms

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles, except where the law of your jurisdiction of residence mandatorily applies. These Terms, together with the Privacy Policy and any institutional agreement, are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date above, and for material changes we will provide additional notice in the Service (which may include requiring you to re-accept before continuing). Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
